On August 7, 1980, Applicant filed a "Rasponse In Oppo-sition To TexPirg's Class 9 Motion' which contained references to the trantcript of the Commission's April 16, meeting at which the Staff's proposed Interim Policy Statement (SECY 131, March 11, 1980) was discussed. As stated in our Response, the Policy Statement adopted by the Commission was identical to the Staff's proposal with only one exception. (Response, p.7 n.1) In filing this Response, Applicant overlooked a pro-vision in the Commission's regulations which precludes parties to NRC proceedings from citing statements made at open Commis-sion meetings in filings with NRC licensing boards.
