UNION OF CONCERNED SCIENTISTS REQUEST FOR EXTENSION OF TIME TO FILE DIRECT TESTIMONY ON CONTENTION 5 On August 5, 1980, UCS filed a motion for summary judgment on UCS Contentions No. 5 and 13. The Board's Order of August 20, while noting an inclination to require the filing of responses to the UCS motion, did not order them. UCS subsequently requested the Boarc to order responses to Contention No. 5 by September 10, so that we would be able to use them in preparing our testimony.

Union of Concerned Scientist. Response to Board Order of August 20, 1980 (Aug. 29, 1980).

Since the Board has not yet ruled, UCS hereby requests an extension of time to file direct testimony on Contention No. 5 until 10 days after responses to our summary judgment motion on that contention are received. As we have previously argued, -1/ UCS is entitled to responses and requires them in 1/ See Letter from UCS to the Board, August 19, 1980.
