Illinois has instituted a Request for Action pursuant to 10 C.F.n.

52.206 requesting that the Commission institute a proceeding to consider revocation, suspension or modification of NIPSCO's construction permit to const uct the Bailly Nuclear Power Plant.

The Request is based upon the considerations of the poor location of Bailly and the difficulty of evacuation planning.

l l The Federal Emergency Management Agency (FEMA) has begun a study of l emergency planning within a ten mile radius around the Bailly site.

l That report is due by June 20, 1980.

1 Illinois requests that subsequent to the release of the FEMA report a meeting be held between the State of Illinois and the Director of the Office of Nuclear Reactor Regulation to discuss Illinois' Request For Action. The meeting should include representatives of the NRC Office of State Programs involved in emergency planning and representa' i.ves of FEMA and its contractor, Wilbur Smith and Associates.

BAILLY GREEN TICKET RESPONSE TO ILLIN0IS ATTORNEY - GENERAL (N0. 09004)

Per your July 8th request to Youngblood, I have determined that we have not issued a request to NIPSCO to do a risk assessment study for Bailly as was done for Limerick.

The delay in deciding to do so is due to a disagreement within the staff as to the criteria for establishing the list of priority candidates for these risk assessment studies. This task is being conducted at the request of the Comission. (Refer to the quoted paragraph in my draft response to Illinois.) I believe that this dis-agreement will shortly be terminated since the Comission on June 30th gave us advance notice of Proposed Rulemaking on Reactor Siting (Attachment 1). In this notice, the Comission nudged us " . . . to continue to develop a priority list of those plants in the highest population areas . . ."

In summary then, we have not yet issued a request to NIPSCO for a risk assessment study. However, we will with a high probability, do so shortly. Accordingly, we should keep the Bailly reference in the accompanying Green Ticket letter (No. 09004) since it provides a basis for neither denying or granting the Petition for a hearing at this time. We would reach a decision on granting the petition when we complate our action per the Comission's request.

Jim Murray of OELD believes that the last paragraph is probably the best course of action to take at this time but is willing to discuss this matter with DL manage-ment.

Finally, FEMA has released its nine evacuation studies, including Bailly, to the appropriate state and local governments for coment. I estimate it will be a number of weeks 'rence before we would be prer ared to go forwar to the meeting regarding the FEMA report requested by Illinois'and the illy Intervenors.
