REQUEST OF ECNP INTERVENORS TO HRC FOR THE PROVISION OF FREE TRANSCRIPTS Pursuant to 45 Federal Register 49535, " Procedural Assistance in Adjudicatory Licensing Proceedings," dated July 25, 1980, the Environmental Coalition on Nuclear Power requests that the Nuclear Regulatory Comission provide these intervenors with a free copy of the transcripts of all prehear-ing conferences held thus far in this proceeding, as well as a copy of the transcripts of all sessions p the evidentiary hearings and any subsequent appeal hearings that lie ahead.
It is our understanding that documents required of intervenors later in this proceeding will be copied and distributed by the Comission free of charge.
ECtlP notes for the record that this action by the Commissioners is a long-overdue step in the right direction toward effective and beneficial public participation in administrative proceedings, but it remains a holicw gesture in the absence of provision of documents requested in discovery. ECNP notes also that lack of adequate access to transcripts and to other documents, resultant from the NRC Staff's and the Board's refusal to provide them at earlier stages of this proceeding,has fatally curtailed ECNP's effective participation in these hearings and has led to harshly punitive measures that will cause most of ECNP's adnitted contentions to remain unaddressed.
In consequence, the record will be pSO3 faulty and incomplete.
