August 26, 1980 Susan N. Sekuler, Esq.

Assistant Attorney General Environmental Control Division 188 West Randolph Street Suite 2315 Chicago, IL 60601 In the Matter of General Electric Company (GE Morris Operation Spent Fuel Storage Facility)

Docket No. 70-1308 (Renewal of SNM-1265)

Dear Ms. Sekuler:

This is to confirm our telephone conversations of August 14, 19 and 21, 1980.

These conversations are part of the Staff's continuing efforts, initiated in telephone conversations of July 16, and 17, 1980, to reach an informal agree-ment concerning the deposition of NRC Staff members by the State of Illinois.

As the Staff rtated in "NRC Staff Objection to Notices of Deposition and Requests for Pt' Action of Documents," dated July 18, 1980, the NRC Staff is willing to discuss reasonable arrangements to make available one or more Staff members for oral examination on deposition regarding any matter, not privileged, which is relevant to the issues in this proceeding. The Staff also stated that it will attempt to reach an informal agreement with Illinois concerning particular Staff members to be made available for oral deposition who may have specialized knowledge of matters to be identified by Illinois.

In our last conversation, on August 21, 1980, you stated that John Van Vranken, also Counsel for Illinois, will contact me to specify the particular subject matter of any depositions, so that the Staff can determine the appropriate personnel to be examined. Accordingly, I await further reply from Mr.

Van Vranken. At the time of such reply, I would also wish to discuss the location for taking the depositions of Staff personnel.

Sincerely,

!A.\\
