Dear Mr. Gay:
l This is to confirm our telephone conversation of April 8, 1980, concerning ACORN's position as to the stipulation proposed by the Staff and Appli-cants which covers the contentions ACORN has filed in this proceeding (as revised through the parties' negotiations or in certain instances as originally proposed).
In our conversation, you stated that although ACORN does not intend to sign the stipulation, ACORN intends to advance only the contentions set forth in the attachment to the stipulation. As stated in the stipulation and based upon our conversation, the renumbering and reword-ing of the contentions set forth in the attachment supersedes that set forth in ACORN's Supplemental Petition and Contentions of Intervenors, dated May 7, 1979. Accordingly, the Staff's statement of position, to be filed in accord-ance with the Atomic Safety and Licensing Board's " Order Scheduling Prehearing Conference", will address those contentions, as opposed to the contentions contained in ACORN's " Supplemental Petition".
