Dear Mr. Lewis:

In your letter of March 3,1980, you indicated concern relative to obtaining information with respect to Three Mile Island 2 (TMI-2) Lessons Learned being applied to certain nuclear plants under construction and also to Three Mile Island, Unit 1.

First, I believe that it would be useful to you if I explained our licensing process. Prior to those plants under construction going into operation, they must receive an operating license. This process is initiated by an applicant making application to the Nuclear Regulatory Commission (NRC) and providing certain documentation to include a Final Safety Analysis Report (FSAR).

The FSAR sets forth the pertinent details of the final design of the facility and a detailed review of the information is made by the staff. At the conclusion of our review, a Safety Evaluation Report (SER) is issued by the staff stating our findings.

In addition to our review, the Advisory Committee on Reactor Safeguards (ACRS), an independent statutory committee established to provide advice to the NRC on reactor safety, makes an independent evaluation and presents its advice to the Commission. Additionally, a public hearing may be held by an Atomic Safety and Licensing Board (ASLB) if there is intervention.

Only after each of these steps have been satisfactorily completed can an operating license be issued.

The NRC is in the final stages of development of an Action Plan for the Commission's review and approval. This Action Plan will implement recommen-dations of the President's Comission and other studies resulting from TMI-2 to include the Lessons Learned. The Action Plan will include new or improved safety objectives, the detailed criteria for their implementation and the various implementation deadlines. Any new safety requirements arising from the approved Action Plan will have to be evaluated to determine whether they are applicable to each plant and will be applied accordingly. The SER will reflect our evaluation of these matters.

Therefore, in response to your inquiry regarding plants under construction, the information you are seeking will be provided in SER's to be issued for each respective facility and will include our findings on the Action Plan which includes the Lessons Learned. When the SER's are available, they may be purchased from the National Technical Information Service, Springfield, Virginia 22161.

In addition, you may also follow the proceedings of the ACRS and if a hearing is held, the ASLB proceedings. Announcement of these proceedings are reported in the Federal Register.

An order issued by the Conmission defining the detail actions required for this review which include the Lessons Learned is enclosed (Enclosure A). A SEP, will be issued addressing al,1 items specified in the order and an ASLB proceeding will be held. Again, the information you are seeking in response to TMI Unit 1 will be in the SER and the ASLB proceedings.

Finally, with respect to the Crystal River incident, I am enclosing a letter (Enclosure B) that was sent to all Babcock and Wilcox operating reactors in which a description of the sequence of events for the incident is given together with the planned corrective actions to the Crystal River plant being taken by the Florida Power Corporation.
