Basis:
Many systems have had to operate at TMI 52 unatten e for over a year.
These systems are required to operate to j
keep ge reactor in a safe condition after the accident on 3-28-99.
These systems were not designed to operate unattended for over a year.
Contention:
In the event of a repeat of the TMIf2 3-28 N accident, these same systems will have to operate unattended for over a year.
These same systems must be qualified at TMI 51 to operate unattended for over one year before restart of TMI#1.
Discussion:
Herman Dieckamp states in a letter to Aherne l
dated 3-4-80 that there are various systems which may fail et TMIf 2 because they had to operate for an entire year and they were not designed to do so. Specifically, he refers to
' loss of effective poison #on P 3.
The Staff refers to the same problem in NUREG 0662 in reference to air cooling fans.P 4-3.

The staff and utility have both argued that steps must now be taken at TMI#2 due to degradation and possible failure of

equipment which has been used continuously for over a year, unattended, to protect the health adin" safety off the publio.

Further, most of the information in this petition has only been in my hands a few days.
2 Conclusion?
The nexus with T'AI#2 is clear.
Specificity 18 not lacking, but will require a period of discovery to determine all systems which have had to operate unattended for over a year. Under the Board's own criteria in its 12-18-89 Order and the Commission's 3-14-80 Order,- the above contention must be accepted as meeting all criteria.(@
