Dear Members of the Board:
Pursuant to 10 C.F.R.
S 2.730(c), this letter is submitted in response to the October 3, 1980 NRC Staff Motion To Set Aside Schedule For Summary Disposition.
For the reasons set forth belt,s, General Electric presently is unable to respond to the NRC Staff's motion.
General Electric, as of this date, has not been provided a copy of the new Part 72 to Title 10 of the Code of Federal Regulations nor has it been published in the Federal Register.
Without adequate opportunity to review those new regulations, General Electric can not determine whether motions for summary disposition would be appropriate at this time regarding all, some, or none of the pending contentions admitted by this Board.
General Electric has been informed by the NRC Staff that the final version of Part 72 will not be available prior to October 20, 1980.
That is the same an.c, which the existing schedule establishes for filing of motions for summary disposition.
In view of General Electric's desire to expedite this licensing proceeding as much as possible, General Electric will review the new regulations as gn:ckly as it can and will respond to the NRC Staff motion described above within three weeks after' receipt of the regulations.
