Dear Mr. Chaiman:

The NRC Staff wishes to seek clarification of two points set forth in your Memorandum and Order dated October 3,1980, regarding the scheduling of the forthcoming environmental hearing to commence on January 12, 1981 to avoid possible conflict in the future.

First, is it correct to assume that if the issues are litigated (or disposed of by summary disposition) and completed sooner than contemplated by the schedule, subsequent issues will be moved up in the schedule so that a full two weeks of hearing will occur?

For example, under this procedure if cooling lake contentions are finished by January 20, 1981, energy alternatives or transmission line contentions would be moved up in the schedule so that they would commence on January 21, 1981 rather than February 2,1981 as reflected in the schedule. The Staff believes that issues should be moved up in the schedule where reasonable and practical to do so in order that the hearing dates reserved are filled.

Obviously, a change in the hearing schedule would be detemined by the Licensing Board after a consideration of the circumstances and a discussion by the parties.

Second, the October 3 Order has scheduled " Emergency Planning" as an issue to be heard during the period February 23-27, March 2-6,1981. This issue is normally considered to be a " safety" rather than an " environmental" issue and is_ evaluated by the Staff in its Safety Evaluation Report (Section 13.3).

Accordingly, the Staff believes that the issue on emergency planning (,i.e_.,

Schuessler Consolidated Contention 1) should be deferred until the radiological health and safety segment of this proceeding because of its " safety" nature and because emergency planning procedures are in a state of evolution at the present time. The NRC upgraded its emergency planning regulations to be ef-fective on November 3,1980.

(See 45 Fed. Reg. 55402, August 19, 1980). The Allens Creek Applicant will be required to revise its PSAR submission on emer-gency planning to. reflect these new regulations. Therefore, this issue should be deferred until the revision is submitted and reviewed by the NRC Staff.

OF JUNE 30 - JULY 3,1980 MEETINGS WITH ALABAMA POWER COMPANY REGARDING OPERATING LICENSE APPLICATION A team composed of staff from the Office of Inspection and Enforcement and the Office of Nuclear Reactor Regulation visited plant and corporate managers from the Alabama Power Company. The purpose of the visit was to review management and technical competence for operation of Farley Unit 2, as required by Item I.B.l.2 of NUREG-0694, "TMI Related Requirements for New Operating Licenses."

A summary of the meetings is enclosed. A summary report by the Office of Inspection and Enforcement is contained in Report No. 50-364/80-27, dated August 28, ~ 1980.

SUBJECT:

SUMMARY

OF JUNE 30-JULY 2, 1980 MEETINGS WITH ALABAMA POWER COMPANY (APCo) CONCERNING FARLEY UNIT 2 An NRC team visited APCo at the Farley Nuclear Plant on June 30-July 1,1980 and at corporate headquarters in Birmingham, Alabama on July 2,1980 to review APCo's management and technical competence with respect to operation of the Farley Nuclear Plant, Unit 2, as required by TMI Action Item I.B.l.2 The team was composed of NRC staff members from the Offices of Inspection and Enforcement (IE) and Nuclear Reactor Regulation (NRR).

IE had the lead for the visit and review as designated for TMI Action Item I.B.1.2 The team members and the APCo personnel with whom we met are listed in Enclosure 1 The team held discussions with the Farley Plant Manager and interviewed plant personnel at the Farley Plant on matters including operations staffing plans and overtime work policies, operating procedures, training,-individual responsi-bilities, and interviewees' perspectives of how plant operations are carried out and how operating experience is disseminated to the plant personnel.

Personnel interviewed included two shift supervisors, two shift technical advisors (STA), a reactor operator, an auxiliary operator, a maintenance foreman and an instrument serviceman as well as plant technical staff and operations supervisors.

Team members, except for the IE Resident Inspector, traveled to the corporate offices in Birmingham on July 2,1980 where it continued its review and held discussions and an exit interview with APCo corporate managers. In the exit interview, the NRC team advised APCo of the areas that it considered unresolved.

These included the APCo proposal for implementing the NRC requirement for an independent onsite safety engineering group and the duties of the STA during normal, routine plant operations.

These problems were subsequently resolved in later discussions and APCo sub-mittals to the NRC. The resolution of these as well as other staff concerns is documented and discussed in detail in Supplement No. 4 to the Farley Nuclear Plant, Unit 2, SER.
