Dear Mr. Tedesco:

River Bend Station - Units 1 & 2 Docket Nos. 50-458 & 50-459 Gulf States Utilities Compan,' has received your letter dated August 21, 1980 which enclosed a ccpy of an August 11, 1980 Memo-randum of Agreement (" Agreement") among the Advisory Council on Historic Preservation, the Louisiana State Historic Preservation Of ficer and the Nuclear Regulatory Commission ("NRC") regarding the proposed transmission line through the Port Hudson National Historic Landmark, Louisiana associated with the construction of the River Bend Station.

In accordance with the NRC's request, this letter will indicate the acceptance by Gulf States Utilities Company of the "S:1pulations" contained in the Memorandum of Agreement. Specifically, the following commitments and representations are made by Gulf States Utilities Company:

Gulf States Utilities Company will comply with and be bound by the " Stipulations" specified in the Agreement.

In addition to the Stipulations directed to construction activities, Gulf States Utilities Company also recognizes its obligation to provide timely reporting and notifica-C,00CL tion to the signatories of the Agreement as necessary to S

l provide for proper and timely execution of its terms.

Gulf States Utilities Company understands that failure to carry out the terms of the Agreement, whether on its part or the part of its agents or contractors, will require the NRC to again request the comments of the Advisory Council on Historic Preservation (" Council") in accordance with 36 CFR Part 800.

Any failure on the part of Gulf States Utilities Company to carry out the terms of the Agreement shall be reported promptly by it to the NRC Office of Inspection and Enforce-ment, Region IV and to the other signatories of the Agreement.

In the event the terms of the Agreement are not carried out by it, and pending resolution of the matter, Gulf States Utili-ties Company will not take or authorize any action or make any irreversible commitment that would result in any adverse effect with respect to National Register of eligible properties covered by the Agreement, or would foreclose the Council's consideration of modifications or alternatives to the construc-tion of the subject 230 kV transmission line and the expansion of the existing transmission corridor for the River Bend Nuclear Station, Units 1 and 2.

Gulf States Utilities Company will provide to the NRC, within 60 days of completion of the construction actions, a written report on the actions taken to fulfill the terms of the Agreement.
