UNIT 1 - CONSTRUCTION COMPLETION DATE Gentlemen:

This is in reply to your letter of July 11, 1980. Our present best estimate of the construction completion date and fuel load target date for the Zimmer Nuclear Power Station is October 31, 1981. Your letter indicated that this information was needed by the NRC in order to establish licensing priorities.

In our view, review of the Zimmer plant must not be delayed. The application for the operating license has been pending since 1975. Some contentions have been heard by the ASLB and the hearings on the remaining contentions could probably have been completed by now, if the NRC/ FEMA position on emergency planning had been promptly developed following the TMI accident.

Further, any construction related to these contentions could have been completed in a timely fashion.

Since the interruption of the hearings because of the absence of a Staff position on emergency planning and the develop-ment of the State and local plans for Zimmer as a result thereof, l the Licensing Board has granted four additional late filed petitions for intervention. Obviously, this is likely to prolong
the contested hearings. Finally, it is noted that before fuel I can be loaded, review by the Appeal Board end by the Commission, l

requiring as much as an additional 80 days, in accordance with Appendix B, Part 2, is now required.

We expect to ask shortly that the hearings begin on the remaining issues to the extent possible at this time.

The Staff has indicated that it may also factor in the reserve margin of the utility's area reliability coordinating region when determining licensing priorities. It is our belief that looking at the individual utility's needs and status is still a more appropriate method of establishing licensing priorities.
