Docket No. 50-466 4,!

(Allens Creek Nuclear Generating i

Station, Unit No. 1) l C"

To: Mr. Sheldon J. Wolfe, Board Chairman August 14, 1980 This is to place on record that which I advised'you on the 13th August in Houston -- that the Board's Order dated 27th and served 30th 1

June 1980 was not received by Intervenor, D. Marrack!

A copy was generously provided by Baker & Botts, fundated received 9 August 1980), " Applicant's Response to Marrack's Motions o Compel Answers to Interrogatories."

This followed a telephone conversation with Mr. Copeland on 31 July at which time it was i

apparent that the Board's Order of 27 June had not reached me.

See footnote p. 2 of above applicant's response.

In the above circumstances, the 26 July Motion to Compel was 1

inadvertantly unavoidably inappropriate.

l Appeal,f the 27th June Board's Ruling becomes regrettably but unavoidably antimely in the circumstances.

Respectfully submitted, q _,~7 a d -
