NRC STAFF REPLY TO PETITIONER'S

" STATEMENT CONCERNING CONTENTIONS" INTRODUCTION On_ August 12, 1980, Petitioner Carol Gilbert filed with the Board a docu-ment. entitled." Statement Concerning Contentions." In her statement, Peti-tioner makes two " requests" of the Board. The first is for an extension of the time to file contentions. The second is a request that an attorney be made available to her.

DISCUSSION By this Board's Order dated July 24, 1980, Petitioner's contentions were to be filed by August 14, 1980. The Staff has no objection to a reasonable ext'ensionlof' time for filing contentions. However, adequate time should be provided for the. Staff to respond to the contentions, and for the Board to consider the Staff responses, prior to the prehearing' conference scheduled 80082'I'0//01

K b for September-10, 1980. The Staff suggests that if Petitioner filed her contentions _by August 22, 1980, the other parties could file responses by Septeinber 4,1980, giving the Board some time for consideration prior to the prehearing conference.

l The Staff opposes Petitioner's request that an attorney be made available to her. Based on the advice of the Comptroller General of the United States and the Commission's' clear reading of the legislative history associated with the fiscal year 1980 appropriations legislation, the Commission has only recently declined to consider Intervenor funding. Metropolitan Edison Company (Three Mile Island Nuclear Station, Unit No.1), CLI-80-19,11 NRC 700(1980).

For the foregoing reasons, the Staff does not oppose a reasonable extension of time for filing contentions, but believes the Board should deny Petitioner's 4

request that an attorney be made available to her.
