On May 26,-1977, Intervenors Other Than Dow (Intervenors)Jfiled in this proceeding the. " Affidavit of Richard J. Timm in Response' to Rebuttal T'stiimony Filed 'by Consumers Power Company and the Nuclear e

Regulatory Commission Staff" (Tim Affidavit). ~ The Timm Affidavit was in response to the Board's-Order (Tr. 6162) permitting the filing l

of surrebuttal testimony by Intervenors.

- By its Motion and Supporting Memorandum.of June 21, 1977, Consumers

seeks to strike portions of-the Timm Affidavit.

The portions sought

- to be struck are identified by Consumers in Att,achment A-to its Motion which addresses. par ~ graphs 36 and 43 of the Timm Affidavit.

conclusions and therefore 'n'ot within the expertise of-the witness and so are appropriate subjects of a motion to strike.

The Staff: supports Consumers' Motion.

In paragraph 36, Dr.'Timm discusses

- what, in his-view, is the appropriate treatment of " sunk costs" in an b

alternatives analysis.

The. question of the proper treatment of " sunk

costs"'is'a legal one as'is clear from the discussion of that subject both in Aeschliman v. U. S. Nuclear Regulatory Commission, 547 F.2d 622 (D. C.- Cir.,1976) and Public Service Company of New Hampshire (Seabrook~ Station, Units-1 and 2), CLI-77-8, 5 NRC (March 31,'1977)

(Slip. Op. at 47-53).

In paragraph 43, Dr. Timm reaches a conclusion on the ultimate legal issue'in.this proceeding, namely suspension of the Midland Plant

pending
the outcome of full remanded hearings.

Furthermore, Dr. Tinn's

" testimony" in that paragraph is argumentative and far beyond any area of his proven' expertise.

The' StaffLhas supported motions by Consumers -to strike portions of Dr.

'Timm's testimony which the Staff considered to consist of legal conclu-sions and argument.1/ The Staff-takes the same-position on the Motion
