Mr. Cherry's untimely remarks appear ' to' derive from some ' parsonal mistrust of Consumers Power Company which he is nurturing. Regrettably, he seems to have permitted his own animosities for the Company'to color significantly his review of the record compiled in this proceeding. 'It is neither necessary nor appropriate at this late date for us to repeat the discussions set forth in our post-hearing briefs. The decisions ( 'mado regarding what information should be included in Joseph Temple's [ dircct, testimony were fully explored..'Similarly, the absence of i 1 ~ l any. communication by Dow to Consumers concerning the extent to which the prospect of subsequent litigation influenced.the ultimate decision l of the=Dow'U.S.A.' Board to honor existing contract obligations was E i' ' carefully: probed and' conclusively established.- Mr. Cherry's obser.- i .vations on these matters reflect a surprising ~ lack of familiarity -i i with the record he claims to have read -- even for-one who shunned -{ -thochearing and. declined to participate in briefing.the issues before 1 1 tha Board. E = ' We would' add only that Mr. Cherry's staunch defense of' k Milton Wessel's admitted "_ sporting" tactics comes as no real-surprise.
