Arthur W. Murphy, Esq., Chairman Atomic Safety and Licensing. Board Columbia University-School of Law l

435 West 116th Street New York, N.Y.

10027 in the Matter of Consumers Power l

Company Midland Plant, Units 1 and 2 Docket Nos. 50-329 and 50-330

Dear Chairman Murphy:

l The AEC Regulatory Staff's Response to Environ-met.tal Contentions dated February 25, 1972, states:

.{

-We believe that the scope of the environ-mental evaluations to be performed in this proceeding must be determined in this and other instances by applying a " rule of l

reason".

l-We believe this is a correct staement of t.he develop-i ing law.

l i'

l Application of this principle, however, will be

. difficult-until satisfactory guidelines are avilable from i

the Commission and the courts.

Accordingly, we continue.to L

believe that the.Doard should seek to-refine-each problem to

'ts most i

specific details before making a decision.

We believe

-this can-best-.be done in'the context of a Hearing, rather than conceptual pre-hearing argument or discovery, and therefore

--urge that the Hearing re-commence as promptly as possible.

Jespectfully, k.$ f d %Cf &fo /
