FE DRAND W AND ORDER On Septed er 2, 1976, the Atomic Safety and Licensing Board (the Board) received a-telegram frcm the licensee requestitg that the Board defer the filing of briefs and other proceedings before it in this cause. The licensee stated that it had filed a notion on August 26,'

1976 uith the U. S. Nec1 car Regulatory Ccrission GGC) requesting a recall of the 12C order of August 16, 1976 institutits this proceedirg;.

The telegram stated that the Comission had. directed all interested parties to file c:rf reply or cther pleading to the licensee's notica to recall with the Camissien on Septe6er 7,1976. In view of this circumstance, the licensee asks that this Board defer further action until the Comission acts on the licensee's pending notion to recall.

The telegram also advised that the intervenors' counsel objects to the request to defer and that the NRC Staff counsel does not believe that pendency of the notion to recall before the Cocmission is necessarily a ground for deferral, although Staff counsel does consider an extension i

The Board will treat the September 2,1976 telegram from the

licensee as a motion and will rule on it in this Mecorandun and Order.-

' At present this Board has a mandate to act in this proceeding under a e

Comission Memorandun and Order which is still in full force. The

!L Cocn:ission Ma:orandu:n and Order of August 16, 1976 requires this Board l

- to determine whether the construction permits for l'idland should be 1

a i-continued, nudified or suspended until a fuel cycle rule has been nude effective, and it specifically requires the Board to call for briefs:on this issue. It would be inappropriate for this Board to assume that the Co::nission will recall its August 16, 1976 Menorandun and Order be-l

-cause the. licensee has a pending notica requesting such action _be taken.

Further,: the deferral requ$sted is for an indefinite period since this Board has no way 'of knowing when the Comission will rule on the

. licensee's cotion to recall.

In the Board's opinion, a stay of action-L in this' proceeding by, thisL Board is not warranted under the circumstances.

Since the licensee has not set forth any other grounds that would; justify a f

deferral of the'filfag of briefs or other action in this proceeding, 1

  • / The Board would normally await responses by the other parties before ruling on this motion. However, 'in view of -the licensee's representa-

' tion of the positions of the intervenors and NRC Staff, and in light of the Board's resolution of the issue,-it is unnecessary'to await cany such-replies.
