'On March 9, 1978, the Atomic Safety and Licensing Board issued a Notice of Prehearing Conference in which it listed five matters, identified by the Appeal Board as subjects to be considered in the reopened Midland proceeding:
"1.
Appraisal of the environmental impact of the

Consideration of the possible effects of energy I
conservation in reducing or eliminating the need for a plant of this size.
3.
Consideration of whether changed circumstances have affected the Dow Chemical Company's need for process steam which it is to receive from one of the units l
under an existing contract.
4.- Consideration of ' unresolved safety issues,' ' design problems,' 'other problems' and their ' resolution,'
' additional matters of concern to the committee,'
and ' clarification of the ambiguities' involved in
,F the ACRS letters and reports, as discussed in the
,l Aeschliman opinion and referred to by the Appeal Board.

On April 3, 1978, the Supreme Court issued its decision in Vermont
'F Yankee Nuclear Power Corp. v. Natural Resources Defense Council and Consumers Power Co. v. Aeschliman (Nos.76-419 and 76-528, U.S.
).
The Commission requests the parties to state their views as to

what issues, if any, remain for further Commission consideration in.
light of the Supreme Court's decisions.
Submissions should be filed with the Commission by April 24, 1978.
