By its Order.of October-21, 1976, in contemplation of the then scheduled suspension hearing date.of November 16, 1976, the Licensing Board re, quired that the parties plac'e written testimony in the mail by November 5, 197'6.
The NRCl Staff and the Applicant-filed written direct. testimony.
The Intervenors. notified the Board and the parties that they wem net filing written direct testimony.'

of nine pages,- enclosed -with this' motion and entitled "NRC Staff Testimony-
,of Sidney.;E. Feld on Cost of Midland v. Coal Alternatives." Due to Mr.
- Feld's Lother.fextensive/ commitments', including the. preparation of testi:nony 7-
' filed'on November 5, 1976 in..this proceeding, the. Staff was unable to

file written direct testimony by the flovember 5,1976 deadline in an important area of Mr. Feld's expertise -- the cost of flidland compared to coal alternatives.
Although the Applicant has filed, testimony on this subject, we believe it will greatly assist the Board and the parties in developing a full record in this proceeding to have written direct testimony by the Staff as an independent check on the Applicant's direct evidence.
The effect of the October 21, 1976 Board Order with respect to the schedule for filing of testimony was to require written testimony to be placed in the mail eleven calendar days in advance of the hearing.
As a result of the delay in the start of the hearing, Mr. Feld's testimony enclosed with this motion will be filed thirteen days in advance of the hearing.
Therefore, there is no shortening of the period j
o'f advance notice of direct testimony previously ordered by the Board.
Accordingly, it_does not appear that any party would be prejudiced if the Board grants the request of the Staf?.
t The Applicant has c'athorized the Staff to state that it has no objection to permitting the requested late-filing of the identified Staff testimony, but reserves all objections it might have to the testimony on grounds other_than late filing.
In a phone conversation on November 15, 1976,
