Dear Mr. Tedesco:

In a letter from Themis P. Speis to J. K. Fuller, dated February 23, 1979, the Nuclear Regulatory Commission's evaluation and approval of our Physical Security Plan was communicated to us.

Your letter stated in part, "We have completed our review and evaluation of your physical security plan and have concluded that the physical security plan for your facility, when fully implemented, will provide the protection needed to meet the requirements of 10 CFR 73.50, the requirements of 10CFR 73.60, the general performance requirements of 10 CFR 73.55(a) and the objectives of the specific requirements of 10 CFR 73.55, paragraphs (b) through (h), and is acceptable." We believe the underlined portion of the above paragraph is in error, and should reference 10 CFR 73.40 and 10 CFR 73.55 instead. Would you please either confirm our analysis by issuing a letter of correction or explain the basis for the statement of applicability to 10 CFR 73.50 and 10 CFR 73.60.

Your letter also states that the Security Plan Evaluation Report (SPER) is being withheld from transmittal pending review for classified information, and that it will be separately transmitted at a later appropriate time. We request that the SPER now b'e forwarded to us for our review.

Dear Mr. Fuller:

The Commission has issued the enclor ed Amendment No.19 to Facility Operating License No. DPR-34 for Fo'-t St. Vrain, Unit No.1, in response to your submittal of October 31, 1977, as revised April 10, 1978 and August 30, 1978.

The amendment incorporates the " Fort St. Vrain Unit No.1 Amended Security Plan" into License No. DPR-34 effective February 23, 1979.

We have completed our review and evaluation of your. physical security plan and have concluded that the physical security plan for your f acility, when fully implemented, wi'.1 provide the protection needed to meet the requirements of 10 CFR 73.50, the requirements of 10 CFR 73.60, the general performance requirements of 10 CFR 73.55(a) and the objectives W

of the soecific requirements of 10 CFR 73.55, paragraphs (b) through (h), anc is acceptable.

A Security Plan Evaluation Report (SPER) represents our evaluation and acceptance of your physical security plan. The SPER is proprietary information and is being withheld from public disclosure pursuant to 10 CFR 2.790(d).

In addition, the SPER is being withheld from transmittal pending review for classified information.

At the appropriate time, the SPER will be transmitted to you under separate cover.

When all aspects of your approved plan have been implemented, on or before February 23, 1979, we request that you notify both the Office of Inspection and Enforcement and the Office of Nuclear Reactor Regulation, at which time a compliance. inspection will be scheduled by the Office of Inspection and Enforcement.

Public Service Company of Colorado Changes which would not decrease the effectiveness of your approved security plan may be made without approval by the Commission pursuant to the authority of 10 CFR 50.54(p).

A report containing a description of each change shall be furnished to the Director, Office of Nuclear 2NN Reactor Regulation, U. S. Nuclear Regulatory Commission, Washington, D. C. 20555, with a copy to the appropriate NRC Regional Office within two months after the change is made. Records of changes mace without Commission approval shall be maintained for a period of two years from the date of the change.

A copy of the Notice of Issuance is also enclosed.
