REPLY IN SUPPORT OF MOTION FOR ORDER UNDER 10 CFR S2.740(e)

In opposing Porter County Chapter Intervenors' Motion for Order Under 10 CFR 52.740(e)(3), both NIPSCO and the Staff cite, quote and discuss subsections (2) and (3) of 52.740(e) . However, neither mention subsection (3) . We quite agree that absent an order or agreement there is no duty to supplement discovery

• responses, other than as provided in subsections (1) and (2).

Subsection (3), which is the part of the regulation upon which the motion relies, provides:

(3) A duty to supplement responses may be imposed by order of the presiding officer or agreement of the parties.

It is just such an order which we seek.*

• NIPSCO further points out that it has "added to the documents" (although not previously telling anyone that it has) . NIPSCO's indication that it has in-fact voluntarily partially supple-cented its responses supports the propriety and desirability of the order we seek.
