HRC STAFF ANSWER TO THE PETITION OF LAKE COUNTY BOARD OF C011MISSIONERS TO INTERVENE On February 13, 1981, the Nuclear Regulatory Commission (Connission) published in the Federal Register (45 Fed. Reg. 12372) a notice o' opportunity for a hearing on the application for an operating license for the Perry Nuclear Power Plant, Units 1 and 2.
On fiarch 15,1931 a petition for leave to intervene was filed by the Lake County Ohio -
prosecuting attorney on behalf of the Lake County Board of Conaissioners and the Lake County Disaster Services Agency. The undersigned NRC Staff-counsel discussed this matter with fir. Ezzone, the assistant prosecuting attorney of Lake County on Friday March 27, 1981.
Mr. Ezzone has read 10 CFR Part 2 and states that the County wants to be admitted under 10 CFR $2.715 as an interested government agency. The Staff has no objection to granting the petition if, and when, it is determined that a hearing will be held.
In the absence of appropriate intervention, the operating licensing procedures will be delegated to the Director of Nuclear Reactor Regulation and na barings will be held. Only admission of a properly qualified intervenor under 10 CFR 92.714 will commence an administrative proceeding.
