WITHDRAW APPLICATION AND TERf11NATE PROCEEDING On December 17, 1980, the Staff responded to the flotion of Applicant herein by indicating that a determination on said motion should be held in abeyance until the Staff has had the opportunity to evaluate the present Sumnit site conditions since a Linited Work Authorization (LWA) had been ' issued in 1975.
An inspection of the site was conducted by the Commission Inspection
& Enforcement staff ~on January 27, 1981.(copy attached). The report of inspection indicates that there are no items of noncompliance with the
- conditions of the LWA and that there are no adverse environmental effects from the onsite work performed by the applicant under the LWA.
The Staff has no objection to the termination of this proceeding and withdrawal of. the application without prejudice.
