MEMORANDUM AND ORDER The New England Coalition on Nuclear Pollution (NECNP) has moved the Comis-sion to direct the Appeal Beard to certify its Memorandum and Order of February 12, 1981 for Comission consideration and to reverse that decision. The Public Service Company of New Hampshire (PSCNH) and the MRC staff oppose that motion.
For the reasons discussed below, that motion is denied.
The subject Appeal Board order denied NECNP's motion to compel the staff and PSCNH to respond to certain interrogator'ies. An order which sustains objec-tions to discovery is wholly interlocutory.1/ The Rules of Practice specifically preclude the appeal of interlocutory decisions to the Comission, y or any other request for Comission review of such a decision. 3/ Thus, NECNP's motion must be denied because it is not permitted by the rules.
