MEETING

SUMMARY

AND CANCELLATION OF NEXT MEETING LICENSEES:

Nuclear Fuel Services, Inc. (NFS) and

New York ~ State Energy Research and Development Authority (NYSERDA)

(License No. CSF-1)

FACILITY:

Western New York Nuclear Service Center, West Valley, New York

Purpose:

To discuss with the co-licensees for the Western New York Nuclear Service Center facility indemnification and liability issues associated with implementation of work by the staff's contractor, Rockwell Hanford Operations, to inspect and evaluate the condition of the high level liquid waste storage system at the facility.

Place and Date: Nuclear Regulatory Commission (NRC) Office of Nuclear Material Safety and Safeguards, Silver Spring, MD October 23, 1980

A meeting was held among NRC, Department of Energy (00E), NFS, NYSERDA, and

' Rockwell Hanford Operations to discuss the issue described above. The site operator desires that there be adequate indemnification for the type of industrial accidents that may result from these activities.

In addition, the site operator desires that the burden o# proof of the source of any damage discovered as a result of these -inspections be placed upon the inspecting activity (Rockwell.

and/or the federal government).

In consideration of NFS's request, NRC provided a draft indemnification agreement which was intended to address NFS's concerns as well as protect the interests of the federal _ government.

Some detailed provisions of the proposed indemnification agreement were in dispute at the close of the meeting, but enough progress had been made for involved parties to agree to meet again to attemot final resolution.

with the next few days. As a result, the meeting scheduled for October 30, 1980 and announced in my memorandum to you dated October 27, 1980 has been
