A NRC STAFF COMMENTS ON ORDER SETTING FINAL PREHEARING CONFERENCE On itarch 10, 1981, the Board issued an Order scheduling a final prehearing conference in this matter for April 7,1981 pursuant to 10 CFR 5 2.752.
In its Order, the Board requested the parties to file any: suggestions on actions to be taken by the Board at the prehearing conference by March 31, 1981.
The Staff will be prepared to discuss all of the matters designated for consideration at this prehearing conference pursuant to 10 CFR s 2.752, including but not limited to, the identification of witnesses and the order in which the contentions should be heard for adjudication.
In this regard, the Staff believes that the Board should set a final date by which the Intervenor may file a request to remove the present bar to his presentation of an affinnative case as permitted by the Board's Memorandum and Order on the subject, dated March 9, 1981. Given the extensive time which has elapsed since the introduction of the discovery motion underlying the March 9,1981 Order and the advanced stage of the
. proceeding..the Staff believes that any such requests should be filed on 1810824 00M G

a or before the April 7 prehearing conference in order to permit their disposition at that time.
The presence of a bar on the introduction of an affinnative case does not deny Intervenor other assistance a technical expert may wish to provide nor deprive the Board of the views held by any such individuals.
Such individuals may assist the Intervenor in case preparation, including his cross-examination of Applicant and Staff witnesses.
In addition, any such person who so desires may express his/her position on the matters at issue in a limited appearance statement (see 10 CFR 6 2.715) which could, if deemed necessary, stimulate appropriate evidentiary consideration.
