On May 7,1980, the Director of the Division of Fuel Cycle and Material Safety, Office of Nuclear Material Safety and Safeguards, pursuant to the Atomic Energy Act of 1954, as amended, and the regulations in 10 CFR Parts 2, 30, and 35, by Order, effective immediately, imposed on all teletherapy licensees lictc

  • amendments requiring the installation of a teletherapy room radiation monitor and the use of specific substitute measures wnenever the monitor is not operational.

By letter dated May 15, 1980, Lincoln B. Hubbard, Ph.D., Chairman of the Legislative Comittee of the Midwest Chapter of the American Association of Physicists in Medicine, who is not a teletherapy licensee, requested a nearing en the Order.

Pursuant to the Atomic Energy Act of 1954, as amended, and the regulations in Title 10, Code of Federal Regulations, Part 2, notice is hereby l

given tnat an Atomic Safety and Licensing Board composed of Administrative Judges Andrew C. Goodhope, Chaiman, Frederick P. Cowan, and Kenneth A. McCollum has been designated to detemine whether a hearing is required and to preside over the proceeding in the event that a hearing is ordered.

If the Atomic Safety and Licensing Board detemines that a hearing is required, a hearing will be held at a time and place set by the Board.

If a hearing is held, the issues before the Board to be conside e.d and l

decided, as set forth in the May 7, 1980 Order, shall be:

(a) Whether the circumstances described in Section I of the i

May 7,1980 Order provide an adequate basis for the actions ordered; and (b) Whether the license should be modified to recuire the i

installation of a radiation monitoring device in each teletherapy room or use of a substitute ' measure as ' set i

forth in Part II of the May 7, 1980 Order.

If a hearing is held, a prehearing conference will be held by the Atomic Safety and Licensing Board to consider pertinent ratters in accordance with the Commission's Rules of Practice. The date and place of hearing will be set at or after the prehearing conference and noticed in the Federal Recister.

Required papers shall be filed by mail or teiegram addressed to the Secretary of the Commission, U.S. Nuclear Regulatcry Comission, Washington, D.C. 20555, Attention:

Chief, Docketing and Service Branch, or by delivery to the Comission's Public Document Room,1717 H Street, N.W., Washington, o.C. 20555.

Pursuant to 10 CFR 2.785, the Comission authorizes an Atomic Safety and Licensing Appeal Board to exercise the authority and perform the review functions wnich would otherwise be exercised and performed by the Commission. The Appeal Board will be designated pursuant to 10 CFR 2.787, and notice as to membership will be published 'in the Federal Recister.
