INTERVINOR'S REUEST FOR THE TlNVENING OF A SPECIAL PRE-MEAR NG CONFERENCE

~i Interrenor hereby requests that the Atomic Safety and Licensing ' 3 3

Board convene a special pre-hearir.g conference pursuant to 10 CFR 2.751a.

for the purpose of hearing argument and ruling on the admissibility of Interrenor's cententions which were not stipulated to as admissible in the November 28, 1980 stipulation. Interrenor makes this request based on the belief that in the absence of a special pre-hearing conference the interests of due process and fai: ness cannot be fairly served.

Pursuant to the terms of the stipulation Interrenor has serted on or before November 28, 1980 a statement of position regarding the admissi-bility of all contentions not subject to stipulation as admissible. This statement of position sets forth Interrenor's azguments as to why each of Interrenor's contentiens are admissible in this proceeding and is h .5 adequate to inform the Boa =1 of the bases for Interrenor's belief that each contention should be admitted. However, the submission of such I!

statements by all parties does not allow Inter /enor an opportunity to respond to the arguments raised by other parties in opposition of admission.

Ccnsequently, the special pre-hearing conference should be convened.*
