M to ua NRC STAFF RESPONSE TO MOTION TO WITHDRAW APPLICATION AND TERMINATE THIS PROCEEDING The Staff of the Nuclear Regulatory Cormission (Staff) hereby responds to the Motion of Delmarva Power and Light Company for itself and its co-applicant Philadelphia Electric Company, dated December 5, 1980, to withdraw application and terminate this construction permit proceeding.

The Staff is of the view that a determination on Applicant's motion should be held in abeyance until the Staff has had the opportunity to evaluate the precise condition of the Summit site, in terms of all activities undertaken by the Applicants on the site pursuant to the Limited Work Authorization (LWA) issued on August 7, 1975. The Staff will provide the Board with the results of its review. Withdrawal of the application and termination of the proceeding l

shall be on such terms and conditions as the presiding officer shall prescribe:
