PETITION FOR LEAVE TO INTERVENE A

JoAnne Bier, Patrick Barnett, and Shirley J. Johns, on their ow behal: and on the behalf of the people living within a 50-mile radius of Big Rock Point Nuclear Power Station, hereby petition the Nuclear Regulatory Commission (NRC) for leave to intervene in the above-captioned matter pursuant to Section 2.714 of the NRC's Rules of Pratice.

Identification of Petitioners JoAnne Bier resides in Charlevoix, Michigan, and lives approximately three miles south-west of Big Rock Point.

Patrick Barnett has lived in the vicinity of Big Rock Point, however at the time of this intervention, he is living in the Detroit area attending school.

Shirley J. Johns resides in rural Antrim County and lives approximately 15 miles south-west of Big Rock Point.

Interests to be Affected All three petitioners are concerncd with the continued operation of such an outdated, antiquated and generally unsafe nuclear plant as Big Rock Point.

The above mentioned plant is 18 years old.

It does not meet minimum safety require-ments established by the NRC.

Thus the continued operation of Big Rock Point subjects them to a potential health ha::ard-not only physically, but mentally as well. The safety and environmental risk have not been adequately considered in any previous hearing.

Contentions 1.

The Spent Fuel Fool at. Big Rock Point is not on the Emergency Bus.

In the event of Loss-Of-Offsite Power, there would be no recirculation of Spent Fuel Pool cooling water. And, according to NUS Corporation reports on Big Rock Point's spent fuel pool, in the event of Loss-Of-Offsite Power the spent fuel pool would boil.

2.

Big Rock Point is operating with inadequate plant shielding.

In the event of fission product inventory release, plant personnel, the public and the environment would be threatened. The N.R.C. has stated the necessity if Licensee to implement plant shielding. Licensee proposes implementation by 1982.

Plant shielding must be implemented now.

Ventilation valves to insure containment integrity have failed or-leaked again, and again. Big Rock Point must remain closed until an adequate valving procedure is implemented. And a better Quality Assurance program is established to insure that these valves remain operationel.

The Reactor Depressurization System (RDS) was installed in 1977.

The RDS has failed to operate efficiently and adequately. Without the RDS working properly, ECCS at Big Rock Point will not function. Therefore Big Rock Point must remain shut down until a better procedure for depressurizing the reactor is implemented.

The service water system for Big Rock Point has only one cooling train and is powered from normal alternating current power. Loss of service water supply to essential plant components in the event of Loss-Of-Offsite Power would be catastrophic.

6.

Big Rock Point is the only commercial nuclear power station licensed to use plutoni"m, and has been using plutonium in the form of mixed-oxide fuels since 1969. Plutonium is the most dangerous substance known to man.

This substance will not be safe for 16,000 generations. Therefore Big Rock Point should cease operation to protect the health and safety of the public and the environment.

Conclusion For all these reasons, we urge that the Licensee be made to implement the safety issues in question or shut down Big Rock Point on the basis of the stated contentions.
