LICENSEE'S RESPONSE TO UCS REQUEST FOR EXTENSION'OF TIME TO FILE DIRECT TESTIMONY ON CONTENTION 5 On September 10, 1980, UCS filed a request for exten-sion of time to file direct testimony on UCS Contention 5.
Licensee opposes the request.
UCS bases its request on the fact that it has pending before the Board a request that the Staff and Licensee be re-quired to respond by September 10, 1980, to UCS' August-5 motion for summary disposition of Contention 5, so that UCS might use the responses in preparing its testimony.
The short answer is that, without waiting for the Board to rule on UCS' request for responses to the motion for summary disposition, both Licensee and the Staff have already filed. pleadings providing in substance the responses which UCS requests..These filings were not directed to the motion for summary disposition.
They were directed instead to UCS' letter 9 6.

e to the Board dated August 19, 1980, and to the Board's Me.mo-randum and Order dated August 20, 1980, requiring the Staff and Licensee to treat the UCS letter as a motion for recon-sideration of the Board's disposition of UCS' August 5 motion.
Each of the Licensee and Staff filings sets out, hcwever, the response which Licensee and the Staff would have made to the motion for summary disposition had such a response been made.
The Licensee and Staff filings were made on September 2,
1980, and September 8, 1980, respectively--well ahead of the September 10 date proposed by 'TCS.
