MEMORANDUM AND ORDER September 12, 1980 The Licensing Board today entered an order in this spent fuel pool capacity expansion proceeding.

In that order, the Board,' inter alia, directed (at pp.18-19) the staff to prepare an environmental impact statement " covering the environmental impacts of an expanded spent fuel pool and the additional term of operation of the facility that such expansion would permit".

At the ' conclusion of the order (p. 19), the Board referred to us, -pursuant. to 10 CFR 2.730 (f), the rulings underlying that direction.

The referral.is accepted.

Those parties which disagree with the referred rulings, either in whole or in significant part, shall file and serve

. their briefs on or before October 20, 1980.

Those parties de-siring to support the rulings below shall file and serve their responsive briefs on or before November ~24, 1980.

Reply briefs may be filed on or'before December 10, 1980.

A copy of the Licensing Board order is being furnished to the Acting General Counsel of the Council on Environmental 1

Quality.

The Council is invited to file a brief amicus curiae expressing its views on the referred rulings.

Any brief in re-sponse to this invitation shall be due either on October 20 or November 24, depending upon whether the Council is in substantial agreement or disagreement with the referred rulings.

It is so ORDERED.
