DPR-54 APPEfiDIX A fl0TICE OF VIOLATION As a result of the inspection conducted between November 3 and 28,1980, and in accordance with the Interim Enforcement Policy 45 FR 66754 (October 7,1980),
the following violations were identified:
A.
.10 CFR 50, Accendix B, Criterion XVI, states in part, " Measures shall be established to assure that conditions adverse to quality, such as...
nonconformances are promptly icentified and corrected."
Quality Control Instruction 1, Revision 7, Processing of Nonconforming Reports, ilCR's, Section 5.8 states that the Manager of Nuclear Operations or the Manager of Generation Engineering are responsible to insure prompt closure of the NCR's in their areas of responsibilities.
Contrary to the above, the liovember 7,1980 flCR Status Report lists I;CR's which have not been promptly corrected.
This is a Severity Level V violation (Supplement I).
B.
10 CFR 50.59(b) requires that the licensee furnish the NRC annually or at such shorter intervals as may be specified in the license, a report which includes a summary of the safety evaluations of each change, test, and experitent made pur::uant to 10 CFR 50.59.
Technical Specification 6.9.3 requires a monthly report be provided which includes a tabulation of facility changes, test and experiments made pursuant to 10 CFR 50.59.
Contrary to the above, the monthly reports for May, June and July,1979, did not include the summary of safety evaluations discussed in 10 CFR 59.59(b) such that the annual requirement for these sumaries was not fulfilled.
This is a Severity Level VI violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, SMUD is hereby required to submit
. to this office within twenty-five days of the date of this flotice, a written statement or explanation in reply, including:
(1) Admission or denial of the alleged items of noncompliance; (2) the reasons for the items of noncompliance if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further items of noncompliance; and (5) the date when full compliance will be achieved. Under the authority of Section 162 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
