Appendix A NOTICE OF VIOLATION Netropolitan Hospital License No. 21-10140-01 As a result of the inspection conducted on January 13, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
1.
Condition No. 16 of your license requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
The application dated May 22, 1978, states in Item 7 the Medical Isotopes Committee shall meet not less than once in each calendar quarter.
Contrary to the above, based on a record review and licensee's statements, the Isotope Committee met on March 6, 1979, October 4, 1979, March 11, 1980, and August 1, 1980.
This is a Severity Level V violation (Supplement VII).
2.
Condition No. 16 of your license requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
The application dated May 22, 1978, states in Item 10, survey instruments will be calibrated at least annually.
Contrary to the above, a record review and discussions with licensee representatives show the Victoreen-493 and Victoreen-740 survey instru-ments were calibrated on October 7, 1977, and next on December 12, 1979.
This is a Severity Level V violation (Supplement VII).
3.
Condition No.16 of your license requires that licensed material be possessed and'used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
The letter dated December 5, 1978, states on page 5, the xenon trap system will be surveyed each week.
Contrary to the above, a record review and discussions with licensee representatives show xenon trap surveys have been performed monthly from May 23, 1980, to December 17, 1980.
This is a Severity Level V violation (Supplement VII).

Condition No. 16 of your license requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applicaticas and letters.
Item 10 of the referenced application dated May 22, 1978, states the dose calibrator will be calibrated as follows:
a.
Accuracy of response - monthly; b.
Linearity of response - quarterly; In accordance with procedures described in Appendix D, Section 2 c.
of the Guide for Medical Programs dated November 1,1977.
Appendix D, Section 2, states that accuracy calibrations which do not agree within 15% indicate that the instrument should be repaired or adjusted.
Contrary to the ab ave, a record review showed:
Accuracy checha have not been performed monthly. No checks were a.
made from Febriary 21, 1980, to January 13, 1981.
b.
Linearity checks have not been performed quarterly. No checks were made from July 23, 1980, to Jtinuary 13, 1981.
No corrective action was taken when accuracy checks done on May 3, c.
1979, August 10, 1979, and February 21, 1980, showed the accuracy for cesium-137 was not within the 15% action limit.

Pursuant to the provisior.s of 10 CFR 2.201, you are required to submit to this office within twenty-five days of the date a: this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
