ON LICENSING ASPECTS AT UNION CARBIDE (TUltDO)

On January 28, 1981 Tom Elsasser, Region 1 State Liaison Officer, and I met with the New York State representatives ind' cated in the attached list. The meeting was held in the 10th floor con 6!rence room of Agency Bu11 ding 4to. 2. Egire State Plaza. Albany. New York.

Two general topics were discussed at the meeting:: h)he Departm the division of responsibility between the NYS licensing authority, tand the NRC, and 2) plann Labor;s of a comprehensive emergency plan for the Tuxedo site.
On the first subject the State of New York proposed that all hc.t cell activities be under NRC jurisdiction; other by-product licensing activities in other buildings would remain under the NW York State Department of Labor. This arrangement would clarify licensing authority responsibility.
On the second tq'y it was agreed that a cowrehensive site emergency plant would be desirab e.
It was suggested and agreed tc by all New York State agencies present that a letter addressed to Mr. William E. Davis of the New Yyrk Etate Energy Office from an appropriate NRC officigl would be satisftetory for initiating the agreement. The reply from Mr. Davis would include a statement to the effect that all pertinent New York State agencies were in agreement with the approach.
I am preparing the initial letter for concurrences.
