Dear Mr. Crumpacker:
I am writing in response to your January 21, 1981 letter to Chairman Ahearne regarding the Bailly Generating Station.
In your letter, you state that it is important to the health and welfare of the citizens and residents of Northern Indiana and Chicago that the relationship between the officers of the Northern Indiana Public Service Comoany (NIPSCO), purchasing agents, and the attorneys for NIPSCO's primary nuclear contractor be investigated by the NRC and request the opportunity to present " documentary evidence" con-cerning such matters if public hearings are eventually held in connection with the pending recuest to extend the Bailly construction permit. A date for the Bailly permit extension hcTring has not yet been established.
In addition to the testimony preented by the parties to this proceeding, interested members of the public are per.'itted to make limited appearances in l
order to enter oral or written statements oncerning the matters at issue in the proceeding on the record.
If you desire.w can forward the information in question to the Chainnan of the Licensing Boar!, Mr. Herbert Grossman, Esq.,
in advance of the eventual hearing date.
Irrespect've of the hearino process, however, the NRC Staff is interested in any information suggesting that some risk to the public health and safety is present as the re.: ult of activities authorized by this agency. You should bring any such information to the attention of the NRC Regional Office of Inspectian ino Enforcement in Glen Ellyn, Illinois so that such infonnation may be g!ven prompt consideration.

Dear Mr. Ahearne:
My attention has been called to the enclosed article appearing in the Saturday, January 17, 1981 edition of the Chicago Sun Times.
My wife, Mary Eleanor M. Crumpacker, 17 Glendale Park, Hammond, and I are the owners in fee simple of an 80 acre rectangular tract of land lying in the Town of Dune Acres, West Chester Township, Porter County, Indiana.
The tract is immediately adjacent to the NIPSCO tract occupied by the Bailly fossil fuel plant and the proposed Bailly lear plant.
My grandfather and great-uncles owned, at one 'ime, 2,000 acres of Dune land on Lake Michigan in N orthern Por*.er County.
During World War II, I served as legal officer to Colonel Nichols, Commanding Officer, Manhattan Engineer District, Oak Ridge, Tennessee.
As attorney for the New York Central Rail Road I acted as a purchasing agent along with Henry Coffman of the industrial development department of the rail road in assembling the Burns Harbor tract presently occupied by the Bethlehem Steel Company.
My wife and I purchased, as agents, 52 separate tracts.
After clearing the titles, we conveyed the lands to the FarmersState Bank of ' alparaiso as trustee.
I participated in transacticis with the NTDS;O and others in exchanging various tracts of land for the proposed industrial development.
Through my participation in various condemnation cases wherein I have represented the land owners against the Indiana Port Commission,
. Indiana State Highway Commission (Federal Bureau of Roads), and the United States of America (Indiana Dunes National Lake Shore), I believe that-I have developed a complete familiarity with the problems
. confronting the Nuclear Regulatory Commission.
