Dear Ms. Faulkner:

This letter is in response to your December 8,1980 letter to Chairman Ahearne. In your correspondence, you commented upon the activities involving the Three Mile Island (TMI) Nuclear Station with emphasis on the delay in the restart of Unit 1.

As you may be aware, the resumption of operation of TMI-1 is the subject of a hearing by an Atomic Safety and Licensing Board (ASLB) of the NRC. That hearing started on October 15, 1980 and is ongoing. The Commission's primary commitment is to a fair and thorough hearing and decision. Given this over-riding imperative, it is the Commission's expectation that the ASLB will con-duct the proceeding expeditiously. The record on which the Commission will make a decision on resumption of operation of TMI-l will include a recom-mendation from the ASLB. Because of the unique nature of the TMI-1 Restart Proceeding and the broad spectrum of issues under discussion, it is difficult to provide a definitive schedule at this time.

As you noted, numerous modifications are being made to the TMI-l facility, as well as to other nuclear facilities, based upon operating experiences and recommendations from nuclear industry groups. The NRC staff continues to be active'y involved in the review of technical infonnation relating to these modifications.
