In the Matter of CONSUMERS POWER COMPANY (Big Rock Point Plant)

Docket No. 50-155 (Spent Fuel Pool Modification) 5

Dear Ms. Johns:

This letter is in reference to my telephone conversations with you and Ms. Bier of November 26, 1980, and to your Petition for Leave to Intervene filed with the Comission on November 13, 1980.

In these telephone conversations you and Ms. Bier informed me that you did not intend your petition to be considered as a petition for leave to intervene in the pending spent fuel pool expansion proceeding, since Ms. Bier is already an intervenor in that proceeding.

I have checked the status of the Big Rock docket and have found no other pending proceedings in which to intervene.

If you have any further questions on this matter, I can be reached at (301) 492-7313.

Sincerely, Janice E. Moore Counsel for NRC Staff cc: Herbert Grossman, Esq.
