/

December 24, 1980 CHAIRMAN The Honorable Robert S. Walker United States House of Representatives Washington, D.C.

20515

Dear Congressman Walker:

This is in response to your letter of November 26, 1980 regarding the request of Charles W. Me11inger, Treasurer, Lebanon Steel Foundry, to meet with the Commiss!'n to discuss the Three Mile Island situation.

It is our understanding that Mr. Mellinger's request was part of a series of similar letters we received from members of the Lebanon Valley Chamber of Commerce, Lebanon, Pennsylvania. All of these letters have been placed in the Commission's docket file for the Three Mile Island Unit 1 Restart proceeding and referred to our THI Program Office.

In a telephone conversation with a member of our Office of General Counsel, David L. Wauls, Executive Vice President, Lebanon Valley Chamber of Commerce, indicated that the group was primarily interested in discussing issues con-cerning the restart of Three tiile Island, Unit 1.

These issues are currently in adjudicatory proceedings before the Nuclear Regulatory Commission.

This proceeding must be decided solely on the basis of the record built during its Consequently, the Commission, as final appellate body for the agency, course.

should not receive comments on these issues from interested persons in a context other than the adjudication.

5 U.S.C. 557(d)(1),10 CFR 2.780(c).

Mr. Me11inger and his associates were advised by letter of the reason for the Commission's inability to grant their request. Mr. Wauls was further advised by telephone that a member of the Commission was available to meet with 'he group on issues related to the cleanup of Three Mile Islan'd, Unit 2 and other issues not subject to the _ex parte rules.

If.this Commission can be of assistance to you in the future, please do not hesitate to contact me.

Sincerely, g
