Task (Work) Order Ceilings Costs ceilings will be placed in each task order for performance of work under the contract. Such ceilings may be increased by the Contracting Officer (CO) at her/his discretion from time to time by written or verbal notice to the Contractor. Verbal notification of any such increase will be confirmed in writing by the CO.

The Contractor shall promptly notify the Project Officer in writing whenever he believes that the then pertinent ceiling for any task order is insufficient. When and if the amount (s) paid and payable to the Contractor under such pertinent task order shall equal the then pertinent ceiling, the Contractor shall nct be expected to perform further unless the C0 increases such ceiling in an amount sufficient to cover additional work thereunder. The Government shall not be obliged to pay the Contractor any amount in excess of such ceiling.

If and to the extent that such ceiling has been ir. creased, any costs incurred by the Contractor in performance in excess of the ceiling prior to its increase shall be allowable to the same extent as if such ccsts nad ceen incurred after such increase in the ceiling C.

Allowable costs of direct materials shall be determined by the Contracting Officer in accordance with Section 1-15 of the Federal Procurement Regulations in effect on the date of this l

Reasonable and allocable material handling costs may be included in the charge for material to the extent they are clearly excluded from the hourly rate. Material handling i

costs are comprised of indirect costs, including, when appropriate, General and Administrative expense, allocated to direct materials in accordance with the Contractor's usual accounting practices consistent with Section 1-15 of the Federal Procurement Regulations.

NRC-10-79-375, Modification 5 Page 4 of 5 The Contractor shall be reirbursed for items and services purchased directly for the contract only when cash, checks, or other forms of actual payment has been made for such purchased items or services. Direct materials, as referenced by this clause, are defined as those materials which enter directly into the end product, or which are used or consumed directly in ccnnection with the furnishing of such product.

The Contractor shall, to the extent of his ability, procure materials at the most advantageous prices available with due regard tc securing prompt delivery of satisfactory materials, and take all cash and trade discounts, rebates, allowances, credits, salvage, cccmission, and other benefits. When unable to take advantage of such benefits, it shall promotly notify the Contracting Officer to that effect, and give the reason therefor.

Credit shall be oiven to the Governrr t for cash and trade discounts, rebates, allowances, cred'ts, salvage, the value of resulting scrap when the amount of sucn scrap is appreciable, commissions, and other amounts which have been accrued to the benefit of the Contractor, or would have so accrued except for the fault or neglect of the Contractor.

Such b"nefits lost through no fault or neglect cq the part of the Contractor, or lost through fault of the Government, shall not be deducted from gross costs.

(B) The net effect of this modification is to:

Definitize labor rates for period April 2,1981 through October 14, 1981 and add two (2) new categories of labor with applicable rates.

2.

Iricrease the contract ceiling amount by $100,000.00 from $670,925.55 to

$770.925.55.

(C) All ot' er terms and conditions of this contract remain unchanged.
