Reamer You asked for a summary report covering the status of NRC actions which implement Reorganization Plan No. 1 of 1980.

All implementing actions identified in Section IV of the Secretary's Report of August 1980 have been taken or commenced.

Specifically, the-following actions have been taken, according to the terms of the attached, referenced documents:

1.

delegation of authority to the EDO as required by section 2(b) of the Plan ( Attachment A and Immediate Action IV.1 of the Secretary's Report).

2.

emergency procedures and notification according to section 3 of the Plan ( Attachment B and Immediate Action IV.2 of the Secretary's Report).

3.

delegation of authority to the heads of Commission '

level offices, adjudicatory boards, and the ACRS as required by section 1(b)(4) of the Plan (Attachment C x

DELEGATIONS 0 AUTHORITY As of October 1,1980, in accordance with the President's.Reor-ganization Plan No.1 of 1980, you as EDO are delegated the following functions:

1.

Administrative fu.'ctions of the Commission; 2.

Distribution of business among personnel and among administrative units and offices of the Commission; 3.

Preparation of the following estimates and proposals:

a.

Proposals for the reorganization of the major offices withir the Commission; t'

c b.

Budget estimates for the Commission; and

~

c.

Proposed distribution of appropriated funds according to major

' programs and purposer l

4.

Appointing and removing, witiuut any further action by the Commission, all officers and employees except those whose appointment and removal are specifically' assigned by Reorganization Plan No.1 of 1980 to the Commission, the Chairman, a member of the Commission, or to the heads of offices as provided in Section 1 (b) (4) of the Plan.

It is anticipated that you may delegate the authority to appoint, remove and supe. vise the staff within majo organizational units to the heads of such units.

In performing e'ach of these functions, you will be subject to the

l direction and supervision of the Chairman.

However, you will also be l

governed by the genera.l. policies of the Commission and by such regu-latory decisions, findings, ind determinations as the Commission is authorized to make. 'Such govuning actions of the Commission include those relating to reo?ganization proposals, budget revisions and. dis-tribution of.appropria,ted funds.

2 With regard to functions previously delegated to the staff by the Commission, such delegations are now made through the Chairman speaking for the Commission.

Unless instructed otherwise on specific ' matters, it 1

is understood that these functions continue to be delegated to the staff and that you should continue to delegate them to their present levels.

Finally, you w:ll be~ responsible, through the Chairman, for insuring i

that the Commission is fully and currently informed about matters within l

its functions.

I would prefer that Cornlissioners' requests for informa-tion be made through the Chairman's office.

Howev'er, in view of the l

split on the Commission on this issue, Commissioners may still make l

requests directly to the staff.

Unless the Commission provides other-

. wise, the following procedure should be followed:

All such requests should be honored on a timely' basis unless in your opinion they would require a lev:". of resource expendi-ture which would impact on Commission priorities governing ongoing programs.

You should bring those requests to the Chairman along with the resource estimate and any alternate proposal which might satisfy the request at a lower level of resources.

If no alternative can be worked out between the Chairman and the Commissioner making the request which avoids a resource problem, the Commissioner may bring the' question before the full Commission which will make the final determination.

It must be emphasized that any determination by the EDO not to give priority attention to a Commissioner request must be based on the ED0's judgment that the level of impact requires a Commission decision on the

' matters appropriate for priority attention by the staff, and is not an evaluation on the merits of the request.

It delegates the function of appointing, removing and supervising the staff of the following offices (or successor offices),

This delegation of authority does not affect the provisions of Section 1(b)(1) and (3) of the Reorganization Plan regarding the Commission's authority to appoint and remove members of the Advisory Committee on Reactor Safeguards and the Chairman, Vice Chairman, Executive Secretary and members of the Ator.:ic Safety and Licensing Board Panel and the Chairman, Vice Chairman and members of the Appeal Panel.
