The Comission by a vote of 4-0* approved a Memorandum and Order which denies a motion for reconsideration and a motion for stay of the 15-minute notification requirement contained in the emergency planning final rule.

Comissioner Hendrie noted that he concurs with the result and will provide a statement of his separate views at a later date.

(Subsequently, the Order wa3 signed by the Secretary.)

  • Section 201 of the Energy Reorganization Act, 42 U.S.C. 55841, provides that action of the Commission shall be determined by a " majority vote of the members present." Chairman Ahearne was not present when this item was affirmed, but had previously indicated his approval of the Memorandum l

and Order.

Had Chairman Ahearne been present, he would have affirmed H

his prior vote.

Accordingly, the formal vote of the Commission was 3-0 l

in favor of the decision.
