SECY-A-80-186 - Response to Duke Power Co. and Texas Utilities Generating Co. Request for Reconsideration of Emergency Planning
- The Comission by a vote of 4-0** approved a Memorandum and Order which denies a motion for reconsideration and a motion for stay of the 15-minute notification requirement contained in the emergency planning final rule.
Commissioner Hendrie noted that he concurs with the result and will provide a statement of his separate views at a later date.
(Subsequently, the Order was signed by the Secretary.)

- The SECY paper was not identified in the original version of this memorandum.
- Section 201 of the Energy Reorganization Act, 42 U.S.C. 15841, provides that action of the Commission shall be determined by a " majority vote of the members present." Chairman Ahearne was not present when this item was affirmed, but had previously indicated his approval of the Memorandum and Order.
Had Chairman Ahearne been present, he would have affirmed his prior vote.
Accordingly, the formal vote of the Commission was 3-0 in favor of the decision.
