The Comission continued its discussion of the proposed instructions to the Board on the Indian Point Proceeding.
The Comission agreed to:
' Renumber questions 1-4 in the following order:
First -
Question 4 Second -
Question 3 Third -
Question 1 Fourth -
Question 2 Retain question 3 with the parenthetical;
- Delete question 7;
- Accept questions 5 and 6 as drafted;
- Accept question 8 with the word " care" replaced by "wish".
The Chairman noted that the text on pages 6-7 and the footnote on page 7 may need revision depending on the outcome of the one hearing versus two hearing l
approach question.
The Ahearne/Hendrie draft of question 2 (paragraph 25) should read "are feasible and should be taken".
The Comission requested that the OGC:
- Compare the one hearing versus the two hearing apprcach and inform the Comission of what changes would be necessary should the Commission opt for the single hearing approach.
' Prepare another draft reflecting the tentative decisions of the meeting.
- Reexamine the implications of Sholly v. NRC with iespect to the use of the phrase " prior to permitting resumption of operations" (see p. 5 of the proposed memorandum and order contained in SECY-80-179C).

The Comission also noted that Commissioner Bradford would be supplying a footnote (to be inserted at the bottom of p.5, SECY-80-179C).
