Metal Scrap Contaminated with Technetium-99 and Low-Enriched Uranium (Your Letter 7-9-79).

Enclosed for your information are copies of a Federal Register notice of proposed rulemaking and a draft environmental impact. statement concerned with exemption of technetium-99 and low-enriched uranium as residual contamination in smelted alloys.

In my letter to you on July 24, 1979, I said that I would inform you of the Commission's decision on the DOE (ERDA) request for rulemaking on the above subject.

At Affirmation Session 80-42 on September 25, 1980, the Nuclear Regulatory Commission ' approved publication of the proposed rule allowing 45 days for public comment.

The Comment period for the proposed rule expires on December 11, 1930, and the comment period for the draft environmental impact statement expires on December 22, 1980.
