Pursuant to your telephone request of October 29, this letter will confirm Elaine Hemby's telephone conversation with you on August 26, 1980 concerning the U.S. Government licensing requirements for a proposed export of Class 1500 psi Steam Pressure Reducing Valves, valued at $327,000, to India for use in the fast breeder test reactor at Kalpakkam.

NRC has determined that the valves described in your letter of May 16, 1980, and accompanying application, are not under NRC's export licensing authority as they are not " specially designed or prepared" for use in a nuclear reactor.

Based on this conclurion, the Department of Commerce is the licensing authority for these types of valves.

It is our understanding that a specific export license from the Comerce Department is not required as the valves in question can be exported under Commerce's General Destination License.
