The Appeal Board, by Memorandum and Order of October 28, 1980, invited parties to comment on the NRC Staff's letter concerning the authority of Mr. Rubenstein to issue tho notice of opportunity for hearing on the requested construction permit extension which appears at 44 Fed. Reg. 69,061 (1979).

Northern Indiana Public Service Company agrees with the Staff's conclusions concerning the authority of Mr. Rubenstein.
