ADVANCE NOTIFICATION TO GOVERNORS OF TRANSPORTATION OF NUCLEAR WASTE INCLUDING SPENT FUEL Puroose:

To consider the issuance of proposed amendments to comply with certain provisions of the Nuclear Regulatory Commission Authorization Act fcr Fiscal Year 1980 (P.L.96-295).

Category:

A policy matter requiring Commission approval.

Issue:

Section 301 of the NRC Authorization Act, for Fiscal Year 1980 (enacted as Public Law 96-295 on June 30, 1980)

provides, "The Nuclear Regulatory Commission, within 90 days of enactment of this Act, shall promulgate regulations providing for timely notification to the Governor of any State prior to the transport of nucTear waste, including spent nuclear fuel, to, through, or across the boundaries of such State.

Such notification requirement shall not apply to nuclear waste in such quantities and of such types as the Commission specifically determines do not pose a potentially significant hazard to the health and safety of the pe'cl i c. "

This mandate raises the following issues:

(1) The

)

quantities and types of nuclear waste that should require prior notification; (2) The method of notification that I

should be provided to the State Governor; (3) The infor-mation to be provided in the notification; (4) The need to issue a proposed rule for public comment; and (5) The need for state governors to protect sensitive safeguards information.
