The Commission by a vote of 4-0* approved for publication in the Federal Reaister a proposed interpretive rule clarifying that fees will be collected wnen review of an application is completed or the application is withdrawn.

SECY-80-223A - Conforminc Anendments to 10 CFR 2.786(a) and 2.206(cl (CONSENT CALENDAR ITEM)
The Comission by a vote of 4-0* has approved an amendment to' its rules of practice to conform the regulation regarding adjudicatory review time with its revised internal operating precedures which provide that the Commissioners have 10 working days to review the decision of the appropriate office director or of the Appeal Board and the advice of the General Counsel.

III. SECY-80-375 - 10 CFR PART 50 - General Revision of Apoendices G and H, Fracture Touchness and Reactor Vessel Material Surveillance Recuirements (CONSENT CALENDAR ITEM)
The Commission by a 4-0* vote approved for publication in the Federal Renister the proposed rule which amends NRC regulations that specify fracture tougnness requirements for nuclear power reactors and requirements for reactor vessel material surveillance programs.

that the Executive Director for Operations will publish the amendments in final form, if no significant adverse comments or questions have been received on the notice of proposed rulemaking and no substantial changes in text are indicated; (EDO) 3.
that affected licensees and other known interested parties receive a copy of the proposed rule change by direct mail; (SD) (SECY Suspense: 11/14/80) 4.
that the Subcon11ttee on Energy and the Envircnment of the House Committee on Interior and Insular Affairs, the Subcommittee on Energy and Power of the House Committee on Interstate and Foreign Commerce, the Subcommittee on Environment, Energy and Natural Resources of the House Committee on Government Operations, and the Subcommittee on Nuclear Regulation of the Senate Comnittee on Environment and Public Works will be informed by letter.

- Section 201 of tne Energy Reorganization Act, 42 U.S.C.15841, provides that action of the Commission shall be determined by a " majority vote of the members present." Commissioner Hendrie was not present when this item was affirmed, but had previously indicated his approval of this item. Had Commissioner Sandrie been present, he would have affi'.med his prior vote. Accordingly, the formal vote of the Commission was 3-) in favor of the decision.
